Your data is in safe hands with us. The processing of your personal data at www.recycling-magazine.com (homepage) is done in line with the applicable data protection legislation. With this Privacy Statement we wish to inform you of how your personal data is actually processed when you visit our websites and use our app.

2. Data collected and the purpose of data processing

We collect personal data on the basis of your consent to fulfil a contract with you and/or to fulfil a statutory obligation. Personal data is all information relating to an identified or identifiable natural person.

2.1 Usage data

Whenever you visit our homepage, the web shop or use our app we collect usage data:

  • Time and date of your access
  • Browser type and version
  • Operating system
  • Computer data
  • IP address (anonymised).

We store this usage data separately from other information. We process the usage data only for statistical purposes, to ensure system security, for technical improvement and to optimise the service offered. The legal basis for processing is Art. 6 para. 1 (f) GDPR (legitimate interest for the purpose of technically error-free presentation and optimisation of the website) and §25 Para.2 No.2 TTDSG. The data will only be stored for as long as necessary for the stated purpose.

2.2 Data when ordering from the web shop

When you place an order in our web shop we collect the following data:

  • Name
  • Address
  • Telephone no.
  • E-mail address
  • Payment data
  • VAT no. (optional)
  • Fax (optional)

We process the personal data collected from you because it is needed to complete the transaction.

The legal basis for processing is Art. 6 para. 1 (b) GDPR. The purpose of processing is to initiate or complete a transaction. The stored data will be deleted when the purpose of processing no longer applies and there are no further legal or contractual obligations to retain the data. In this case, the statutory retention period is six years.

2.3 Payment process for digital orders

We use the payment service provider PayPal (PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg) to process digital purchases and subscriptions. This process is in line with our legitimate interest to offer an efficient and secure payment method (Art. 6 para. 1 (f) GDPR). In this context, we pass on the following data to PayPal to the extent necessary to fulfil the contract (Art. 6 para. 1 (b) GDPR).

  • Last name
  • Address
  • E-mail address
  • Telephone number

Processing of the data provided under this paragraph is not required by law or contract. Payment via PayPal cannot be processed without transferring your personal data.

PayPal carries out a credit check for various services such as payment by direct debit to ensure your willingness and ability to pay. This is in line with PayPal’s legitimate interest (in accordance with Art. 6 para. 1 (f) GDPR) and serves to fulfil the contract (in accordance with Art. 6 para. 1 (b) GDPR). For this purpose, your data (name, address, date of birth and bank account details) is passed on to credit agencies. We have no influence on this process and only receive the result of whether the payment has been made, rejected or is pending verification.

Your data is saved until the payment process is completed. This includes the time required for processing refunds, claims management and fraud prevention.

2.4 Contact details

When you use our contact form, we collect the following data:

  • Name
  • E-mail address

Processing the personal data you provide is necessary for us to complete your request.

The legal basis for processing is Art. 6 para. 1 (a) GDPR. The purpose of processing is to initiate and/or fulfil the contract. The stored data will be deleted once the purpose of processing no longer applies and there are no further legal or contractual obligations to retain the data.

3. Data disclosure

Personal data will only be disclosed to third parties or contractors of order processors if this is necessary for the relevant purposes. We pass on personal data to specialised service providers, for instance dispatch and payment service providers. Disclosure to foreign states occurs only where this is expressly stated in this Privacy Statement.

In so doing, we ensure through appropriate measures that the third parties provide an appropriate level of protection for the personal data.

4. Deletion of the data

The stored personal data is deleted when you rescind your consent to its processing, when the data is no longer needed to fulfil the purpose pursued by its storage or when storage of the data is or becomes inadmissible for other legal reasons. Upon deletion or freezing of the data the corresponding services can no longer be used.

5. Newsletter and e-mail advertising

5.1 Newsletter

We are happy to keep you informed about exciting projects, news from our blog on architectural and design topics, worthwhile information on research and current events in our newsletter, if you have given your consent to this or if this is in line with statutory regulations.

The legal basis is Art. 6 para. 1 (a) GDPR (Consent).

With your registration (double opt-in procedure) for the newsletter you declare your consent to receive the newsletter. The data collected (title, name, e-mail address) is used only to send the newsletter.

Our newsletter is sent via MailGun, a service of the e-mail service provider MailGun Technologies. MailGun transmits data to the USA. MailGun’s privacy policy can be found here: https://www.mailgun.com/legal/privacy-policy/. MailGun collects and processes the newsletter’s usage data. The information collected is processed in order to technically improve and optimise the newsletter service.

You can rescind your consent to receive the newsletter and the associated processing of data at any time. Rescission is effected via a link in the newsletter or by informal notification to DETAIL Business Information GmbH, Messerschmittstraße 4, 80992 Munich or an e-mail to datenschutz@recyclingmagazin.de

Declaration of consent to receive the newsletter:

I consent to DETAIL Business Information GmbH regularly sending me individualised exciting news and events by e-mail. The processing of my personal data is to be done in line with statutory provisions. I can rescind my consent in respect of DETAIL Business Information GmbH at any time.

5.2 E-mail advertising in accordance with § 7 (3) UWG

We are entitled within the context of the statutory permission under § 7 (3) of the German Act Against Unfair Competition (UWG) to use the e-mail address given by you in your order for direct advertising for similar products or services of our own. If you no longer wish to receive advertising for similar products or services you can unsubscribe your e-mail address at any time without incurring any costs other than the costs of transmission in line with basic rates. The possibility to unsubscribe is contained in every advertising e-mail.

6. Cookies and tracking tools

We use temporary session cookies and permanent cookies. Cookies are text files which are stored on your terminal and which enable an analysis of how the homepage, web shop and app are used. We use cookies and other data collection tools to collect data that helps us to personalise the services we offer. The legal basis for the use of cookies & tracking technologies is Art. 6 para. 1 lit. a GDPR (consent to processing for statistical purposes, to optimise the presentation or for marketing purposes), Art.6 para.1 lit.c GDPR (fulfilment of legal obligations – Borlabs cookie) and §25 para.2 no.2 TTDSG (technically necessary cookies – PHP session). If consent to the use of cookies is not given, some offers on the website cannot be used or cannot be used in full. You can see the storage duration of the individual cookies in the following table.

The website also uses cookies that are absolutely necessary for the technical operation of the website. They do not contain any personal information and are not read by third parties.

When data is processed outside of the EU/EEA and no level of data protection equivalent to the European standard is in place, we have concluded EU standard contractual clauses with the service provider to establish an appropriate level of data protection. Data transfer to the USA and access by US authorities to the data stored by the service providers cannot be ruled out. Regarding data protection regulations, the USA is currently considered a third country. Your rights there are not the same as within the EU/EEA. You may not be entitled to legal remedies against your data being accessed by the authorities.

6.1 Google Analytics

The homepage and web shop use Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics enables analysis of how users are utilising the site. The information collected includes, e.g. information on the operating system, screen, your IP address, website views called up, the date and time of your visit to our website. The information created on your use of the website is generally transmitted to a Google server in the USA and stored there. We have activated IP anonymisation. This means that your IP address will be shortened by Google before transmission within the Member States of the European Union or in other states that are signatories to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address by transmitted to a Google server in the USA and shortened there. Google uses this information on behalf of the website operator to analyse your use of the website, compile reports on activities within the app and to provide other services associated with use of the website to the provider of the app. The IP address transmitted within the context of Google Analytics is not associated with other information by Google.

You can prevent the transmission of data related to your use of the website (including your IP address) to Google and processing of this data by Google by deactivating Google Analytics in your browser.

We wish to inform you that the configuration of Google Analytics on this website ensures the anonymised collection of IP addresses (known as IP masking).

6.2 Google AdWords

Our online shop uses the online advertising program “Google AdWords,” the online marketing system of Google Inc. (“Google”) and in this context conversion tracking (evaluation of visit actions). For this, Google AdWords creates a cookie on your computer if you land on our website via a Google advert.

These cookies lose their validity after 30 days and are not used for personal identification. Every Google AdWords customer receives a different cookie. This means that there is no possibility that cookies can be traced via the websites of AdWords customers. The information collected using the conversion cookie serves the purpose of creating conversion statistics. We are informed of the anonymous overall number of users who have clicked on our advert and been directed to a site fitted with a conversion tracking tag, but we do not receive any information which would enable the personal identification of users.

You can prevent collection of data on your use of adverts and the processing of this data through Google by deactivating Google Adwords in your browser.

6.3 Google Ad Manager for displaying online advertising

DETAIL Business Information GmbH uses Google Ad Manager (formerly: DoubleClick for Publishers (Small Business)) of Google LLC (USA) (“Google”) to display online advertising on its website. It enables DETAIL Business Information GmbH to display certain advertising material to its users. DETAIL Business Information GmbH does not publish any interest-based advertising derived from third-party networks, but only advertising directly marketed by DETAIL Business Information GmbH.

For this purpose Google uses cookies, which do not, however, contain or store any personal data. The legal basis for processing is article 6 paragraph 1 f) GDPR, whereby the justification of DETAIL Business Information GmbH results from the fact that it also wishes to use its costs for operating the website for direct advertising purposes and that users – after considering their reasonable expectations based on their relationship to DETAIL Business Information GmbH as website operator – do not suffer any particular disadvantages as a result.

6.4 Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland
The Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. The Google Tag Manager itself does not create any user profiles, does not store cookies, and does not carry out any independent analyses. It only manages and runs the tools integrated via it. However, the Google Tag Manager does collect your IP address, which may also be transferred to Google’s parent company in the United States.

The Google Tag Manager is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and administration of various tools on his website. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25 (1) TTDSG, insofar the consent includes the storage of cookies or the access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

6.5 eTracker

This website’s provider uses services provided by etracker GmbH based in Hamburg, Germany (www.etracker.com) to analyse usage data. We do not use cookies for web analytics by default. Before using analysis and optimisation cookies, we specifically ask for your consent. If this is the case and you do consent, the cookies are used to enable statistical coverage analysis of this website, to measure the success of our online marketing measures and testing procedures, e.g. in order to test and optimise different versions of our online service or its components. Cookies are small text files that are stored by the internet browser on each user’s device. Etracker cookies do not contain any information that enables user identification.

The data generated by etracker is processed and stored by etracker on behalf of this website’s provider within Germany only and is therefore subject to strict German and European data protection laws and standards. Etracker has been independently audited, certified and awarded the ePrivacyseal data protection seal of approval in this regard.

The data processing is carried out based on the legal conditions of Art. 6 para. 1 (f) (legitimate interest) of the General Data Protection Regulation (GDPR). Our aim in accordance with the GDPR (legitimate interest) is to optimise our online services and web presence. Because we care about our visitors’ privacy, any data that could identify an individual person, such as an IP address, login or device ID, is anonymised or pseudonymised as soon as possible. We do not use the data in any other way, combine it with other data or pass it on to third parties.

You can object to the data processing described above at any time by clicking on the scroll bar. No adverse consequences will result from the objection. If no scroll bar is displayed, data collection is already prevented by other blocking measures.

7. Social Plugins

We use social plugins (“plugins”) of social networks.

In order to increase the protection of your data when using our website, these plugins are not unrestricted, but instead are only incorporated into the site using HTML links (known as the “Shariff solution”). This ensures that using the site does not enable the creation of any connection to the servers of the provider of the relevant social network. When you click on one of the social media buttons a new window is opened and the page of the relevant service provider is called up on which you (possibly after entering your login data) can, for instance, press the Like or Share button.

8. Protecting the privacy of persons under 16 years old on the internet

The personal data of minors (under 16 years) will not be knowingly collected by DETAIL Business Information  or used in any way. We do not generally know the age of visitors to our website. However, we have not taken specific measures to protect such data to any particular extent. Persons under the age of 16 may not transmit their personal data without the express consent of their parents or guardians.

9. Your rights

9.1 Right of rescission

You have the right to rescind the consents you have given to the processing of your personal data at any time with effect for the future.

Such rescission does not affect the legality of processing done on the basis of your consent up to the date of rescission.

9.2 Right to information

You have the right to demand to be informed free of charge of the personal data stored. If you so request, the information can also be sent electronically.

9.3 Correction, deletion and restriction of data

You have the right to demand the correction, deletion or restriction of the personal data relating to you. Upon deletion or blocking of your data, you will however no longer be able to use the associated services.

Your right to deletion can be excluded by statutory retention duties.

9.4 Data export

You have the right to receive from us in machine-readable form the data which we process through automatic procedures and to whose usage you have given your consent, or to have this data transmitted to other responsible persons.

9.5 Enforcement of your rights

10. Data security

We protect your personal data from risks associated with data processing, in particular unauthorised access, utilisation or publication. For this purpose we have appropriate technical and organisational measures in place that are in line with the latest technological standards.
